Terms of Service
Read this first. Don't Guess Sports publishes research. It is not a sportsbook, and it is not advice. Nothing here is a recommendation to risk money, and no outcome is promised. Sports wagering carries a real risk of financial loss.
1.Agreement
These Terms of Service form a binding agreement between you and Don't Guess Sports LLC ("Don't Guess Sports," "DGS," "we," "us"), a Maryland limited liability company, covering your use of dontguesssports.com and any related services, content, newsletters, and tools (together, the "Service"). By accessing or using the Service you agree to these Terms. If you do not agree, do not use the Service.
2.What the Service Is — and Is Not
Don't Guess Sports is a sports research and decision-intelligence publication. We produce analysis, probabilities, market information, and research-driven signals, and we disclose the inputs and reasoning behind them.
We are not a sportsbook, casino, betting exchange, or payment processor. We do not accept, place, or process wagers. We do not hold your funds and we do not receive winnings. We are not an investment adviser, broker, or financial planner, and we are not a tipster or picks service.
3.No Guarantees and No Advice
All content is provided for informational and educational purposes only. Nothing on the Service is financial advice, investment advice, legal advice, or wagering advice.
Analytical outputs, probabilities, projections, and signals are estimates derived from available data. They are subject to error, revision, and change, and they can be wrong. We do not guarantee accuracy, completeness, timeliness, profitability, or any particular outcome.
You are solely responsible for your own decisions and for any losses you incur.
4.Eligibility
You must be at least 18 years old to use the Service, and at least 21 where required by the law that applies to you. Access to wagering-related content is limited to individuals 21 years of age or older.
The legality and availability of sports wagering vary by jurisdiction. You represent that your use of the Service complies with the laws that apply where you are. Determining that is your responsibility, not ours.
5.Accounts
If you create an account, you agree to provide accurate information, keep your credentials confidential, and remain responsible for activity under your account. Tell us promptly at support@dontguesssports.com if you suspect unauthorized access. We may refuse, suspend, or close an account at our discretion.
6.Subscriptions, Billing, and Cancellation
Some parts of the Service may require a paid subscription. Where they do:
- Current plans and prices are shown at the point of purchase and are what govern your order.
- Subscriptions renew automatically at the end of each billing period unless you cancel first.
- You may cancel at any time. Cancellation takes effect at the end of the current billing period, and you keep access until then.
- Price changes apply only going forward, never retroactively, and we will give notice before a change takes effect for you.
- Except where the law requires otherwise, payments already made are non-refundable, including for partial periods. If something has gone wrong with your order, contact support@dontguesssports.com and we will look at it.
7.Acceptable Use
You agree not to:
- Redistribute, resell, republish, or share paid content outside your own personal use
- Scrape, crawl, harvest, or bulk-extract content or data from the Service
- Reverse engineer, decompile, or attempt to reconstruct our models or methodologies
- Misrepresent our research, or present our outputs as guarantees, locks, or promises of profit
- Use the Service to promote unlicensed or illegal gambling operators
- Interfere with the Service's operation or security, or access it by automated means without permission
8.Intellectual Property
The Service and its contents — including text, analysis, models, signals, indicators, graphics, and software — are owned by Don't Guess Sports LLC or its licensors and are protected by intellectual property law. DON'T GUESS SPORTS™ and THE GAME LEAVES CLUES. WE FIND THEM.™ are trademarks of Don't Guess Sports LLC.
We grant you a limited, revocable, non-exclusive, non-transferable license to access and use the Service for your own personal, non-commercial use. No other rights are granted.
9.Third-Party Content and Links
The Service may reference or link to third-party sites, data providers, sportsbooks, or content. We do not control or endorse them and are not responsible for their accuracy, availability, practices, or terms. Your dealings with them are between you and them.
10.Disclaimer of Warranties
The service is provided "as is" and "as available," without warranties of any kind, express or implied, including any implied warranties of merchantability, fitness for a particular purpose, title, non-infringement, accuracy, or uninterrupted or error-free operation. Some jurisdictions do not allow certain disclaimers, so parts of this section may not apply to you.
11.Limitation of Liability
To the maximum extent permitted by law, Don't Guess Sports LLC and its members, officers, and agents will not be liable for any indirect, incidental, special, consequential, exemplary, or punitive damages, or for any lost profits, lost wagers, lost data, or losses arising from decisions you made using the service.
Our total liability for any claim relating to the service will not exceed the greater of the amount you paid us in the twelve months before the claim, or one hundred U.S. dollars ($100).
12.Indemnification
You agree to indemnify and hold harmless Don't Guess Sports LLC from claims, damages, liabilities, and reasonable legal fees arising from your use of the Service, your breach of these Terms, or your violation of any law or third-party right.
13.Termination
We may suspend or terminate your access at any time for violation of these Terms or to protect the Service or other users. Sections 3, 8, 10, 11, 12, 15, and 16 survive termination.
14.Changes to These Terms
We may update these Terms. When we make material changes we will post the revised version with an updated date, and where appropriate we will notify subscribers. Continued use after changes take effect means you accept them.
15.Governing Law and Disputes
These Terms are governed by the laws of the State of Maryland, without regard to its conflict-of-laws rules. You and Don't Guess Sports LLC agree that any dispute arising out of or relating to these Terms or the Service will be brought exclusively in the state or federal courts located in Maryland, and both parties consent to the personal jurisdiction of those courts.
Nothing in this section prevents either party from seeking injunctive relief where it is available, or from bringing an individual claim in small claims court where that court has jurisdiction.
16.Miscellaneous
These Terms and our Privacy Policy are the entire agreement between you and us regarding the Service. If any provision is held unenforceable, the rest remains in effect. Our failure to enforce a provision is not a waiver of it. You may not assign these Terms; we may assign them in connection with a merger, acquisition, or sale of assets.
